Where do the rules for the use of AI in education come from: Lorraine Daston’s typology of rules as an analytical tool

Authors: Ashirov Aziz Abdybekovich, Postgraduate student, Keshishian Maria Ovanesovna, Assistant, National Research University ITMO, St. Petersburg (Russia)

Keywords: artificial intelligence in education; AI regulation; academic integrity; thick and thin rules; pedagogical judgment; tacit knowledge.

The article addresses the problem of the origin and justification of rules governing the use of artificial intelligence in education, as well as the conditions of their effectiveness. The relevance of the study is обусловлена the rapid diffusion of AI in educational practice and the need to develop regulatory approaches that take into account the specificity of pedagogy rather than merely administrative requirements. Based on an analysis of international documents, institutional university policies, and local educational practices, the authors demonstrate that existing models of AI governance predominantly reproduce the logic of “thin” rules—brief and unambiguous prescriptions that exclude interpretation and displace pedagogical judgment. The aim of the study is to identify the sources of rules for the use of AI in education and to assess their alignment with the needs of educational practice. To achieve this aim, the study addresses the following objectives: to analyze existing approaches to AI regulation at the international and institutional levels; to identify the dominant type of rules; and to compare these with the requirements of pedagogical practice. The methodological framework is based on Lorraine Daston’s concept distinguishing between “thin” and “thick” rules, as well as paradigm rules understood as models of thinking and action. In dialogue with this framework, the authors draw on Richard Hughes Gibson’s argument that defining the role of AI in higher education is a pedagogical rather than an administrative problem. The findings show that the gap between “thin” rules produced by formal regulation and the “thick” rules required by educational practice has philosophical foundations and reflects a broader historical tendency toward the algorithmization of norms and the displacement of human judgment. The article concludes by arguing for a shift in AI governance in education from a prohibitive logic to a paradigmatic one, focused on the creation and dissemination of exemplary pedagogical practices.
